  • Project Agreement Specialist

    Responsibilities:

    • Draft project agreements (PAS), Memorandum of Understanding (MoU) and other related agreements, draft/ review scopes of work for evaluations and assessments
    • Work effectively with stakeholder relationship building and liaising with various levels of government
    • Act as liaison, communicate with multiple departments during deployments to deliver timely and quality deliverables
    • Act as the Subject Matter Expert in the interpretation and management of the Project Agreement (PA)
    • Monitor all aspects of the delivery of project and ensure compliance to the PA; provide technical guidance relating to the compliance with the PA
    • Participate in project review meetings; provide technical advice, as it relates to the Project Agreement and how it directly impacts project deliverables including claims, change, invoicing, quality, etc.
    • Participate in the development and oversight of project documents such as project charters, project plans, project process activities, management and SLA’s and contracts
    • Support the implementation of contracts, scope, service level measurements, contract deliverables, invoice reconciliations, reporting and project communications
    • Responsible for supporting the outline of project specifications
    • Support the negotiation of contract changes and claims

    Qualifications Required:

    • Must have a Bachelor Degree in Engineering, or related field
    • Minimum 10 or more years of experience leading the development of Project Agreements
    • Demonstrated experience with large scale infrastructure projects over $500M
    • Demonstrated experience in Alternative Financing Procurement (AFP) procurement methods or P3’s
    • Demonstrated experience with AFP’s to implement lessons learned across existing and future projects
    • Effectively and positively influence Client, Stakeholder team members and general contractors to comply with claims processes as set out in the Project Agreement (PA)
    • Highly effective negotiation skills
    • Excellent presentation abilities with effective communication; ability to positively influence others
    • Good understanding and practical applications of contract administration and document management
    • Experience in both Owner and Contractor role is considered an asset
    • Transit design or project management experience is preferred
    • Experienced as a user in a minimum of one of the following systems: Primavera P6, SharePoint, ProjectWise, Acconex, EcoSys, Oracle Contract Manager or Primavera Unifier

  • Claims Lead

    The Claims Lead is responsible to review, evaluate and monitor variations in the contract during the construction build schedule of the plant. The Claims Lead will monitor third party contractors and able to differentiate between clarifications, changes variations and additions to the scope of work and ensure that Client's interests and entitlements are protected under the contract.

    Responsibilities:

    • Prepare Client Forms for inputting claims and variation data, including updating new data as it becomes available
    • Prepare and /or provide input to the project Variation and Claim Register
    • Monitor records kept by contract management/contract administration and provide analysis for use when substantiation of claims preparation and/or claims defense, as well as determining "ripple effect of contractual variations on project program e.g. TQ's, RFI's, CVI's, labour and plant allocation sheets etc.
    • Liaise with Engineering department to ensure record of employer changes (by way of comments on drawings, e mails, letters, verbal instructions) are being recorded on appropriate spreadsheet and carry out analysis to determine impact on company programme.
    • Participate in managing "early warning/risk reduction procedure including drafting appropriate notices, fact gathering, analysis, participation in risk reduction meetings.
    • Draft contract notices for time extensions.
    • Draft contract notices for reimbursement of loss and expense (prolongation, disruption and acceleration claims).
    • Draft or support contract management with contractual correspondence on all claim related matters.
    • Check out discrepancies and ambiguities in the contract documents as they arise and report on same
    • Draft contemporary records such as Record Vouchers/Incident
    • Reports setting out facts beyond event notes.
    • Prepare claims and claims defense documents including narrative, quantum evaluation and explanatory narrative for program and results of delay analysis.
    • Liaise with project planners to determine time impact of variations and claims including advice on appropriate methodology of delay analysis to be carried out.
    • Prepare contractual and claims strategies for project management.
    • Check all claims during the warranty period.
    • In the event of mediation, prepare position statements for mediation as well as manage the mediation process.
    • Ensuring that all changes requested by the Employer /CA are subject of a written instruction.
    • Reacting quickly after any discussion of change by submitting cost information as well as details of program impact.
    • Ensure that contract rates, schedule of rates, bill rates where nature of work or conditions which it is carried out under do not differ from the original scope of works.
    • Ensure safe working and the highest regard to Health & Safety for all employees, suppliers and contractors working on the project.
    • Ensure all contractual obligations and statutory requirements are met.
    • Promote company policy at all times.

    Qualifications Required:

    • Fifteen (15) or more years of experience with complex construction claims
    • Alternative dispute resolution techniques
    • Commercially astute
    • Efficiently manage and advise numerous claims
    • Negotiations with client and stakeholder team members
    • Positive influencing skills
    • Contract administration and document management software such as CM14 and Aconex are preferred
    • Comprehensive experience of the administration of major construction contracts in excess of $500M
    • Experience with various delivery methods including but not limited to (DBB/DB) and P3 and/or Alternative Financing and Procurement methods

    • Experience in the procurement of complex technical requirements including engineering/architectural design contracts and requests for proposals
    • Required to be able to read and comprehend technical specifications and drawings considered a strong asset

    Responsibilities:

    • Responsible to ensure that the terms, conditions and incurred expenditures of the contracts are maintained and provides timely dispute resolution for contract claims/disputes

    • Oversees payments and costing, confirming alignment with policies, contract terms and requirements
    • Identifies project timing constraints and makes necessary adjustments without affecting the critical path
    • Investigates/negotiates contractor changes and claims while protecting the interests of the project and provides recommendations for settlement
    • Advises project teams in the resolution of contract issues in accordance with the terms of the contract and/or the development of amendments required to the original contract terms
    • Monitors contractor performance, scope control and manages/negotiates contract changes
    • Develop innovative, methodical and robust solutions and procedures to resolve difficult contract issues, disputes and claims while adhering to polices and contract terms
    • Oversees payment/project costing by validating that contract expenditures balance with authorized budgets, Work Releases, Amendments and invoices submitted by the contractor
    • Conducts contract audits to ensure that there are no deviations from contract terms and that contract costs are in compliance with program governance requirements
    • Identifies and advises program consultants/contractors on changes to proposed WBS submittals, and ensures that they align with the terms and scope of the respective contract

    Qualifications Required:

    • Fifteen (15) or more years of experience in combined relevant contract administration and project costing management experience
    • Demonstrated experience in contract administration and contract management of projects greater than $1Billion
    • Contract Management experience on large capital transit projects utilizing various project procurement delivery models including AFP, Design-Build, Design-Bid-Build and P3.
    • Claims and dispute resolution experience related to major capital infrastructure projects, transit project experience
    • Management of stakeholder, vendor, contractor and project team relationships
    • Project costing and Work Breakdown Structure (WBS) developing and standardization
    • Contract and financial auditing experience
    • Has an inherent understanding of program governance framework and is able to leverage the appropriate resources to develop a rational and strategic plan to resolve contract issues in a collaborative fashion

    The Senior Project Planner/Scheduler is responsible for the coordination, preparation and maintenance of Master Project Schedules and monitoring the progress of works of various project contractors in accordance with the program guidelines. These duties will be performed in close conjunction internally with the Project Manager, Project Engineers, Engineering staff and other Project Control team members and externally with the Contractors’ project control staff.

    Responsibilities:

    • Participates in development of project Work Breakdown Structure (WBS)
    • Prepares master project schedule by defining activities, dependencies and interfaces with support from Project Management Team and various engineering team leaders
    • Interacts with the Contractors’ personnel to review and analyze contract schedules
    • Performs schedule/cost analysis, highlights critical paths/risk areas, assesses cost performance during progress updates and communicates issues to the Project Management in order to minimize schedule impacts
    • Updates project schedules with input from teams, consultants and contractors
    • Reviews scope changes and claims for schedule and cost impact and provide feedback to financial and contract management staff
    • Assists in budgeting process by assigning budgets and costs to tasks and develops cash flows utilizing budget and schedule data
    • Prepares schedule reports, graphs and cost/schedule performance reports for project review meetings
    • Develops processes to monitor, expedite and assess contractors’ progress and various project deliverables
    • Prepares project schedule and progress narrative reports as requested by the Project Manager, complete with required metrics utilizing Primavera P6

    Qualifications Required:

    • University graduate plus a minimum of 15 years of experience in a similar capacity
    • Must have good understanding of multi-discipline engineering and construction projects
    • Must have solid understanding of core project control concepts (WBS, CPM based scheduling, Earned Value Progress Measurement), PMBOK/PMI principles
    • Working knowledge of MS Office applications and Primavera
    • Must be well organized and possess good written and verbal communication and presentation skills
    • Must possess the analytical skills to foresee potential problems and avoid them by preplanning

    • Must have hands-on experience in the estimating support function for the preparation of all ranges of estimates, from feasibility study to definitive

    • Knowledge of city infrastructure costs
    • Professional designations such as PQS, CEC, and Gold Seal considered an asset

    • Lead the development of key project deliverables and artifacts such as business requirements, functional design documents, fit/gap analyses, proposed data models, and report mockups
    • Develop OBIEE Analysis based reports and dashboards for central and distributed users
    • Collaborate with the data architecture and technical development team to ensure the creation of an efficient technical solution that meets all functional business needs
    • Identify risks to scope, schedule or budget as they arise; work to mitigate risks

    Qualifications Required:

    • Bachelor of Industrial Engineering with experience working within an IT environment is preferred
